Utah Real Estate Law: Purchase Agreements, Lease-Options, and Boundary Disputes

Real estate is usually the largest thing a family or small business owns. Whether you're buying, selling, renting with an option to buy, or arguing with a neighbor over where the line is, we explain your rights and options in plain English.

What we help with

Purchase and sale agreements

We draft and review real estate purchase contracts so you know your deadlines, contingencies, and earnest money rights before you sign, and help when a deal falls apart.

Lease with option to purchase

We draft and review lease-option agreements that spell out rent credits, the option price and deadline, repairs, and what happens if the buyer can't close.

Property line and boundary disputes

Fences, encroachments, driveways, and easements. We start with the survey and records and look for a written agreement before court.

Other common real estate issues

Title problems, quiet title actions, warranty and quitclaim deeds, transfer on death (TOD) deeds (see /utah-estate-planning), landlord-tenant matters, and HOA disputes.

How it works

  1. Free 20-minute consultation

Tell us about the property and the deal or dispute. We check for conflicts first.

  2. Review the documents

The contract, lease-option, deed, survey, or title report usually controls the answer.

  3. Draft, negotiate, or resolve

We prepare or revise the agreement, or try a clear letter and negotiated agreement first. We explain costs before you decide.

  4. Go to court if needed

If a dispute can't be resolved, we file in the appropriate Utah court.

Frequently asked questions

Should a lawyer review my purchase agreement?

Not every closing needs one, but a review helps when the deal is for sale by owner, seller-financed, unusual, or involves an estate or trust. It's much cheaper to fix a contract before you sign.

What is a lease with option to purchase?

You rent the home now and get the right, but not the duty, to buy it later at an agreed price. A clear written agreement should cover the option fee, rent credits, the deadline, who handles repairs, and what happens if you don't buy.

Is a lease-option risky for the seller or the buyer?

It can be for both if the terms are vague. Common problems are unclear credits, missed deadlines, and repairs. Good drafting prevents most of them.

My neighbor's fence is on my property. What can I do?

Start with a survey. Depending on how long the fence has been there, Utah doctrines like boundary by acquiescence may apply. We usually try a written boundary agreement before going to court.

Can you help with title or deed problems too?

Yes. We handle quiet title, corrective deeds, TOD deeds, and landlord-tenant issues, as well as clouded title that holds up a sale or refinance.
